Auction Terms
1. Introduction
1.1. These Terms & Conditions govern the auction sale of the ceramic artwork (“the Artwork”).
1.2. By placing a bid, all bidders acknowledge and agree to be bound by these Terms & Conditions.
1.3. The seller reserves the right to amend these terms at any time prior to the auction’s close.
2. The Artwork
2.1. The Artwork has been described and photographed with care. Condition, dimensions and characteristics are provided in good faith.
2.2. The Artwork is sold as seen, without warranties or guarantees, except where required by law.
3. Bidding Procedures
3.1. Bids can be made using the widget on the website or by sending an email to: studio@fayemayo.com
3.2. All bids are binding commitments to purchase the Artwork at the stated amount.
3.3. The seller reserves the right to refuse bids that are incomplete, suspicious, or inconsistent with normal bidding behaviour.
3.4. The highest valid bid received at the close of the auction will be deemed the successful bid.
3.5. The seller may, at their discretion, set a reserve price. If the reserve is not met, the seller is under no obligation to complete the sale.
4. Successful Bidder
4.1. The successful bidder will be notified promptly following the close of the auction.
4.2. The successful bidder must confirm acceptance and arrange payment within 3 working days of notification.
4.3. Should the successful bidder fail to complete payment within the stated timeframe, the seller may offer the Artwork to the underbidder or relist the Artwork without liability.
5. Payment Terms
5.1. Payment must be made in full by bank transfer only. No alternative payment methods will be accepted.
5.2. Bank details will be provided privately to the successful bidder.
5.3. The Artwork will not be released to the buyer until full cleared funds have been received.
6. Collection, Transport & Delivery
6.1. Collection is by appointment from Chaldon, Surrey.
6.2. If the buyer requires delivery or courier transport, arrangements and costs are the sole responsibility of the buyer.
6.3. If requested, the seller may recommend art couriers; however, no liability is accepted for their services.
6.4. Risk in the Artwork passes to the buyer upon collection or upon transfer to the buyer’s chosen courier.
7. Returns & Refunds
7.1. All sales are final. No returns or refunds will be accepted unless the Artwork has been materially misdescribed.
7.2. Any concerns must be raised in writing within 48 hours of receiving the Artwork.
7.3. This auction is a private sale and is therefore not subject to standard UK consumer return rights.
8. Seller Rights
8.1. The seller may withdraw the Artwork or cancel the auction at any point before its close.
8.2. The seller may correct clerical or descriptive errors in the listing.
9. Limitation of Liability
9.1. Except where required by law, the seller accepts no liability for indirect or consequential loss arising from the auction or the buyer’s use of the Artwork.
9.2. The buyer participates in the auction at their own risk.
10. Governing Law
10.1. These Terms & Conditions and any dispute arising from them are governed by the laws of England and Wales.
10.2. The courts of England and Wales shall have exclusive jurisdiction.
